Terms of Service

The short version
FacilityTruth provides informational reports describing senior care contracts and publicly available facility data. We are not lawyers, and our reports do not constitute legal advice. You pay $99, we deliver a plain-English informational report. We take privacy seriously and do not share your data. If something goes wrong, email us — we'll fix it.
1. What FacilityTruth is
FacilityTruth is an informational service that describes senior care contracts (assisted living, skilled nursing, memory care, and continuing care retirement community residency agreements) and summarizes publicly available facility data. FacilityTruth produces plain-English informational reports delivered to customers via email. FacilityTruth is owned and operated by David Thomas (the "Service Provider").
FacilityTruth is not a law firm. Our reports do not constitute legal advice, do not create an attorney-client relationship, and are not a substitute for advice from a licensed attorney. Our reports do not represent the opinion of a licensed attorney about any contract clause, any state's law, or any course of action. For any legal question about a contract or your rights under any state's laws, we recommend consulting a qualified elder law attorney before signing. 2. Acceptance of these terms
By purchasing a report or using this website, you agree to these Terms of Service. If you don't agree, don't use the service. We may update these terms from time to time — when we do, we'll update the date at the top of this page. Continued use of the service after changes are posted constitutes acceptance of the updated terms.
3. The service
When you purchase a FacilityTruth report, you provide a contract document and a facility name. We process the contract through our automated system, retrieve publicly available facility data from government databases, and deliver a PDF report to your email address within 30 minutes of payment confirmation in most cases.
Our reports include:
- A contract overview describing what the contract is and what it commits each party to
- A clause-by-clause description of significant provisions, with citations to the article and section in your contract
- Industry context for each described clause
- Federal Medicare facility data where available
- State inspection citation summaries where available
- Questions you may want to consider asking the facility
- Questions you may want to consider asking a qualified elder law attorney
- Resources for finding qualified elder law attorneys and other consumer protections
Our reports describe contract language and summarize publicly available data. They do not constitute a legal determination that any clause is enforceable, unenforceable, preempted, or actionable under any state's laws.
4. Service availability
Skilled nursing facility (SNF) reports are available nationwide. Assisted living facility (ALF) reports are available at launch in California, Florida, Georgia, Illinois, Michigan, New York, North Carolina, Ohio, Pennsylvania, and Texas. Service may be added to or removed from particular states over time. We will note availability constraints clearly on the service order page.
5. Payment and refunds
Reports are priced at $99 per report. Payment is processed by Stripe. We do not see or store your full card number.
Because reports are digital deliverables generated and delivered immediately upon purchase, we generally do not offer refunds after a report has been successfully delivered. Exceptions:
- If your report is not delivered within 30 minutes of a confirmed payment (or 60 minutes for unusually long contracts), you are entitled to a full refund.
- If the report is materially incomplete due to a technical error on our end, you are entitled to a full refund or a reprocessed report at your choice.
To request a refund, email support@facilitytruth.com. We respond within one business day.
6. Your contract and your representations
You retain ownership of any contract or document you upload to FacilityTruth. By uploading a document, you grant us a limited license to process it for the sole purpose of generating your report. We do not claim any ownership rights over uploaded documents.
By uploading a contract, you represent that you are either (a) the prospective resident, (b) an authorized family representative or designated Resident's Representative, or (c) a person with legal authority (such as a power of attorney or guardianship) to share the contract for analysis. You further represent that the contract was provided to you as part of a genuine senior care admissions or care process and that you have the right to share it with us for the purpose of generating your report.
7. Privacy and data handling
Your privacy matters. We do not sell your data, share your contract with third parties, or contact the facility you're evaluating. Senior care contracts contain personal information about prospective residents and family members, which we treat as confidential. We do not extract, index, or use names, addresses, or other identifying details from your contract for any purpose other than generating your report.
At intake, we offer an optional opt-in feature inviting customers to allow a de-identified version of their contract to be retained in our research library. Participation is opt-in only and you receive the same report regardless of your choice. The full description of our PII handling, retention periods, and your rights is in our Privacy Policy.
8. Accuracy and limitations
We make reasonable efforts to ensure our descriptions are accurate and our facility data is current. You acknowledge:
- Facility data comes from third-party government databases and may not reflect the most recent changes.
- Contract descriptions reflect our reading of clause language; reasonable people, including attorneys, may interpret the same language differently.
- Poor scan quality may result in incomplete reading of some sections. We will note in your report if any sections could not be fully processed.
- State inspection data availability varies. Reports note where data was and wasn't available.
FacilityTruth provides information to help you understand a contract and prepare for conversations with the facility and an attorney. We do not guarantee any particular outcome from using our reports.
9. Disclaimer of warranties
FacilityTruth is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law.
10. Limitation of liability
To the maximum extent permitted by applicable law, FacilityTruth and David Thomas shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this service, including but not limited to decisions made based on report contents, lost profits, or any damages relating to senior care decisions, contract execution, or attorney consultation timing. Our total liability for any claim related to a report shall not exceed the amount you paid for that report.
This limitation does not apply to claims arising from our gross negligence, intentional misconduct, or to any liability that cannot be limited under applicable law.
11. Not legal advice — disclaimer of professional services
You acknowledge and agree that FacilityTruth does not provide legal advice, does not create an attorney-client relationship, and is not a substitute for the advice of a licensed attorney. You acknowledge that for any legal question about a contract you are considering signing, including any question about enforceability, your rights under your state's laws, or any specific course of action, you should consult a qualified elder law attorney. You agree not to rely on any FacilityTruth report as legal advice or as a basis for any decision that should be made with the advice of a licensed attorney.
12. Intellectual property
The FacilityTruth website, report format, description framework, and all related content are owned by FacilityTruth and David Thomas. You may use your report for personal, family, and non-commercial purposes, including sharing with family members and an attorney. You may not reproduce, resell, or distribute our content or report format without written permission.
13. Governing law and dispute resolution
These terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any dispute arising from these terms or your use of FacilityTruth shall be resolved in the state or federal courts of Cuyahoga County, Ohio. You agree to submit to the personal jurisdiction of those courts.
14. Severability
If any provision of these terms is held to be unenforceable, the remaining provisions will remain in full effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
